IRIS Sustainable Development Welcomes Landmark UN Backing of World Court Climate Ruling

IRIS Sustainable Development welcomed the adoption by the United Nations General Assembly of a landmark resolution endorsing the International Court of Justice’s (ICJ) advisory opinion on climate change, describing it as a significant milestone for climate justice, human rights and global accountability.


Led by the Pacific Island nation of Vanuatu and adopted with broad support from Member States, the resolution reaffirms that countries have obligations under international law to prevent environmental harm, accelerate reductions in greenhouse gas emissions and protect communities most affected by climate change.


The ICJ advisory opinion clarified that States may be in breach of international law where they fail to adequately regulate fossil fuel production, emissions, subsidies and other activities contributing to climate change. It also underscored that climate action should remain aligned with the 1.5°C target of the Paris Agreement and prioritize the protection of vulnerable populations and future generations.


The International Federation of Social Workers (IFSW) said the resolution reflects longstanding calls by social workers at the United Nations and international climate forums for urgent, transparent and accountable climate action grounded in social justice and human rights.


The Court further stated that where States fail to meet these obligations, they may bear legal responsibility and could be required to cease the wrongful conduct, provide assurances of non-repetition and make full reparations, depending on the circumstances.


Although advisory opinions issued by the ICJ are not legally binding, they carry considerable legal and moral authority by helping to clarify and advance international law and define the obligations of States.


The General Assembly’s adoption of the resolution following the Court’s ruling sends a strong message that addressing the climate crisis is a legal responsibility under international law rather than solely a political choice. “The world’s highest court has spoken,” Secretary-General António Guterres said. “Today, the General Assembly has answered.”


The resolution calls on all Member States to take all necessary measures to avoid causing significant harm to the climate and environment, including through emissions generated within their jurisdictions, and to implement their existing commitments under the Paris Agreement.


It also urges governments to cooperate in good faith and strengthen coordinated global efforts to address climate change while ensuring that climate policies uphold the rights to life, health and an adequate standard of living.


In a statement issued following the General Assembly vote, Mr. Guterres emphasized that those least responsible for climate change continue to bear its greatest burdens and stressed that the path to climate justice “runs through a rapid, just and equitable transition away from fossil fuels towards renewable energy.”


The Secretary-General further noted that renewable energy has proven to be the most affordable and secure source of energy and reaffirmed that the objective of limiting global temperature rise to 1.5°C above pre-industrial levels remains achievable.
